The Bombay Excessive Courtroom on Wednesday quashed a Mumbai Police FIR in opposition to Sunaina Holey for her tweet allegedly selling enmity between two communities.
The Courtroom stated that the tweet didn’t identify any communities and it needs to be judged from the angle of a prudent man, reported Bar and Bench
In keeping with Bar and Bench, “Neither group nor faith is called. If check of sturdy or prudent individual is utilized stated tweet can’t be stated to have created hatred between group or present the petitioner has mens rea,” the Courtroom stated.
The order was handed by a Bench of Justices SS Shinde and MS Karnik on a plea by Holey to quash the FIR registered in opposition to her after she tweeted a video which allegedly had the chance to advertise enmity between non secular communities.
Except for the FIR quashed on Wednesday, two extra FIRs have been registered in opposition to her in connection along with her tweets in opposition to Maharashtra Chief Minister Uddhav Thackeray and State Cupboard Minister Aaditya Thackeray.
