  • Supreme Court’s big comment on PMLA cases, said- bail is the rule and jail is the exception, granted bail to Prem Prakash, a close aide of Jharkhand CM Hemant Soren

New Delhi. In an important decision on Wednesday, the Supreme Court once again made it clear that the principle of “bail is the rule and jail is the exception” should be applied even in money laundering cases. The apex court made this remark while granting bail to Prem Prakash, considered close to Jharkhand Chief Minister Hemant Soren, in a money laundering case related to illegal mining.

Let us tell you that the bench of Justice BR Gavai and KV Vishwanathan has said in its decision that even in cases under the Prevention of Money Laundering Act (PMLA), ‘bail is a rule and jail is an exception. The bench has said in its decision that Section 45 of PMLA only stipulates that granting bail in the crime of money laundering will be subject to two conditions and this provision of this law does not change the basic principle that bail is a rule and jail is an exception. The apex court has said that ‘Section 45 of PMLA only mentions that dual conditions have to be fulfilled for granting bail. But the principle of ‘bail is a rule and jail is an exception’ is a brief description of Article 21 of the Constitution of India which states that a person will be deprived of his life or personal liberty only according to the procedure established by law.

The Supreme Court has said that individual liberty is always the rule and deprivation of anything is the exception. The apex court said that deprivation can be done only by the procedure established by law which must be lawful and reasonable. The Supreme Court has said that Section 45 of PMLA only requires that in cases where bail is subject to satisfaction of dual conditions, those conditions must be fulfilled. The bench said that ‘Therefore we have held that even in money laundering cases, bail is the rule and jail is the exception.

On August 9, the apex court, while granting bail to former Deputy Chief Minister Manish Sisodia in the corruption and money laundering case related to the excise policy, said that ‘bail is a rule and jail is an exception. The Supreme Court has reiterated its comments in the judgment passed in the Sisodia case in this case as well. The Supreme Court has made this remark while ordering the release of Prem Prakash, accused in the money laundering case related to the illegal mining scam in Jharkhand, on bail.

Prem Prakash, considered close to Chief Minister Hemant Soren, had challenged the decision of the Jharkhand High Court in the apex court, which rejected his bail plea. The Supreme Court has ordered the release of Prem Prakash on bail, quashing the March 22 decision of the Ranchi High Court.

Uttar Pradesh Social Media Policy:  In a bold move to harness the power of social media, the Uttar Pradesh Cabinet has approved the Uttar Pradesh Digital Media Policy, 2024. This new policy aims to regulate online content and create a streamlined system for compensating social media influencers who promote government schemes and achievements.
Under the new policy, influencers across various platforms will have the opportunity to earn substantial amounts through state advertisements. The government plans to establish a roster of social media influencers, agencies, and firms, categorizing them based on their follower count and reach. Influencers on X, Facebook, and Instagram will be eligible to receive up to ₹5 lakh, ₹4 lakh, ₹3 lakh, and ₹2 lakh, depending on their category.

For those creating content on YouTube, including videos, shorts, and podcasts, the earnings can be even higher, with potential monthly payouts reaching up to ₹8 lakh, ₹7 lakh, ₹6 lakh, and ₹4 lakh for different tiers.

Sanjay Prasad, Principal Secretary of the state’s Information Department, announced the policy on Tuesday, highlighting its dual aim: to promote government schemes and to regulate content across digital platforms. The initiative is expected to enhance the visibility of state projects and achievements while maintaining a check on the quality and nature of content being shared.

The policy also introduces stringent measures against objectionable content. This development marks a significant shift in how government communications are managed online, reflecting an increased focus on both content regulation and influencer engagement.

  • US: New Indictment Filed Against Trump For 2020 Election Actions | world news

Special Counsel Jack Smith on Tuesday filed a revised indictment against former President Donald Trump, refining the charges related to his attempts to overturn the 2020 election results.

While retaining the core allegations, the superseding indictment omits certain elements in response to the Supreme Court’s ruling on immunity.

Sharing a post on his re: executive immunity.”

The post further said, “It circumvents the need for an evidentiary hearing (the “mini trial”) to determine what charges apply. The DOJ has stated its position in this indictment. The majority of the charges levied against Donald Trump fall outside the scope. of immunity.”

The reworked indictment keeps the same charges but addresses a US Supreme Court decision that broadens presidential immunity, trimming away interactions Trump had with the Department of Justice and zeroing in on his role as a political candidate.

Taking to the social media platform Truth, Trump criticized Smith for filing the case against him and said, “In an effort to resurrect a “dead” Witch Hunt in Washington, DC, in an act of desperation, and in order to save face, the illegally appointed “Special Counsel” Deranged Jack Smith, has brought a ridiculous new indictment against me, which has all the problems of the old indictment and should be dismissed immediately. His Florida Document Hoax Case has been completely dismissed.”

Notably, the central charge remains the same: that Trump attempted to subvert the 2020 presidential election and overturn his loss to Democrat Joe Biden. Trump has long claimed, falsely and without evidence, that widespread voter fraud marred the 2020 race.

The Republican presidential candidate further said that the filing of the case is an attempt to interfere with the upcoming elections. He added, “This is merely an attempt to interfere with the election, and distract the American people from the catastrophes Kamala Harris has inflicted on our nation, like the Border Invasion, Migrant Crime, Rampant Inflation, the threat of World War III, and more….”

The reworked case, unfolding in Washington, DC, is one of four indictments against Trump. He is the first US president to face and be convicted of criminal charges.

Out of the four cases against Donald Trump, only one has resulted in a conviction so far. In May, Trump was found guilty of 34 counts of falsifying business records in New York.

However, even this conviction is now uncertain due to a recent Supreme Court ruling that grants sweeping immunity to presidential actions, potentially overturning the verdict.

  • Apple’s Global Revenues To Cross $400 Billion For 1st Time This Year: Report |

New Delhi: Driven by growth in both hardware and services segments, Apple’s global revenues are expected to cross the $400-billion mark for the first time in 2024, a report said on Wednesday.

After a decline in 2023, Apple’s hardware revenues are expected to grow 3 per cent (year-on-year) in 2024, according to Counterpoint Research.

All the key hardware segments – iPhone, iPad, Mac, Watch, AirPods – are likely to drive this growth supported by new launches. AirPods could emerge as the fastest-growing segment this year.

“In terms of growth rates, and now with the advent of Apple Intelligence, the services segment does seem very exciting. It is poised to grow at a much faster rate than hardware,” said Tarun Pathak, Director, Counterpoint Research.

However, in terms of absolute revenue growth, hardware remains critical in pushing the needle considering it contributes to three-fourths of Apple’s global revenues.

“After a decline in 2023, 2024 will see growth in several key hardware categories driven by multiple launches. Then there is also a promise of Apple Intelligence being implemented across hardware segments, which has once again created some excitement and could drive upgrades,” Pathak mentioned.

Meanwhile, services revenue will continue to grow and reach record levels in 2025, crossing the $100-billion mark for the first time.

Apple Intelligence could boost the services revenue by at least 10-15 per cent in coming years depending on how Apple chooses to monetise, the report mentioned.

In 2025, the revenue from services is likely to become bigger than the revenue from hardware excluding iPhones.

Meanwhile, riding on robust local production, Apple is all set to create 5-6 lakh jobs (direct and indirect) in the coming 1-2 years in India. The iPhone exports continue to clock around $1 billion each month thanks to the government’s production-linked incentive (PLI) scheme.

According to the government, in the ecosystem of Apple alone, more than 2 lakh people have got employment and there is good amount of growth. Apple aims to manufacture more than 50 million iPhones in India per year, as it aims to shift some of the production out from China.
