Saroj Verma, a resident of Raipur, posted on the post of Training Superintendent in the Women’s Industrial Training Institute located in Durg, was transferred by the department to the highly scheduled and Naxalite district Bijapur. Challenging this order, Saroj Verma filed a petition in the High Court.

During the hearing of the case, it was argued on behalf of the officer that as per the rules of Chhattisgarh Government, a government servant who has crossed the age of 55 years will not be posted in the Ghor Scheduled District. Despite the age of the petitioner being 60 years and 4 months, he was transferred to the highly scheduled-Naxalite district Bijapur, which is a violation of the policy.

It was also argued on behalf of the officer that he is suffering from epilepsy, and only 1 year and 8 months are left for his retirement, in such a situation the petitioner will face problems by joining the highly scheduled-Naxalite district Bijapur. Accepting the petition, the High Court has stayed the transfer order of the petitioner.
