Raipur. Raipur special court has sent Anwar Dhebar on ACB remand till April 8 in the liquor scam case. ACB presented Anwar Dhebar, accused in the liquor scam case, in the court and sought remand till April 15. On behalf of Dhebar, senior Supreme Court advocate Nitya Ramakrishnan and Raipur Court advocate Faisal Rizvi challenged the ACB proceedings.
Senior advocate Nitya Ramakrishnan challenged the legal jurisdiction of the ACB proceedings in the liquor scam case citing the Supreme Court’s stay, Noida’s FIR and the High Court’s order. Regarding the arguments given in the court, advocate Faisal Rizvi told The Hit.in – “We told the court that the applicant in the ACB liquor scam case is ED, ED is barred from taking any action in this case by the Supreme Court. . ED lodged an FIR in Noida in the liquor scam case. The Supreme Court directed on that FIR that no punitive action will be taken against any accused.
Rizvi said, ED files the same FIR in ACB in the same liquor scam case on which it has already filed an FIR in Noida. We told the court that 482 (petition to quash the FIR) has been filed in the High Court on this FIR of ACB, while hearing which the High Court has directed the ACB not to take punitive action against the petitioners. A report confirming the serious health of Anwar Dhebar has also been presented in the court.
In response to the serious legal objections raised by the defense on Anwar Dhebar’s remand application, the ACB said in the court that, “This entire issue is related to the ED, the ACB’s case is different. This is a scam of more than Rs 2 thousand crores. Anwar Dhebar has an important role in this scam. We have to recover important evidence. Whatever condition the court sets, we accept it. We should be given remand.
A petition is presented in the High Court on behalf of Anwar Dhebar demanding quashing of the ACB FIR and it is to be heard on Monday. This is a repetition of the same petition on the basis of which Anil Tuteja and Yash Tuteja got relief from the High Court.
