The High Court has determined that a wife’s behavior towards her husband after she achieved a PhD and a high-paying job as a principal constitutes mental cruelty, thereby justifying a divorce. The court’s decision reversed the Family Court’s earlier denial of the husband’s divorce petition. The husband’s petition detailed how his wife’s attitude changed after her academic and professional achievements. During the pandemic, the wife allegedly taunted him for his unemployment and engaged in frequent arguments over minor issues. The court found that these actions amounted to mental cruelty under the law, and also noted the wife’s actions in turning her daughter against her father and leaving the marital home with her in August 2020, abandoning her son and severing ties with both husband and son through a letter.
