The court underscored the necessity of regulating social media content, asserting that unfettered platforms cannot exist. The court pointed out that allowing unregulated content creates an environment conducive to lawlessness, while controlled content protects both freedom and public order. The High Court stated that no social media platform can avoid the legal requirements. The judges noted that X Corp, while adhering to similar regulatory practices in the United States, has opposed India’s framework. The court also dismissed X’s argument regarding free speech and clarified that American legal interpretations cannot be directly applied to the Indian constitution.
