Six judges of the seven-judge bench comprising Chief Justice DY Chandrachud, Justice BR Gavai, Justice Vikram Nath, Justice Bela Trivedi, Justice Pankaj Mittal, Justice Manoj Mishra and Justice Satish Chandra Sharma had given the verdict in favour of sub-classification in SC-ST reservation. Whereas one judge opposed it. While giving the verdict, it was also recommended that there should be a provision of creamy layer in the reservation for Scheduled Castes and Tribes and it should be different from the provision of creamy layer applicable to Other Backward Classes i.e. OBC class.
